One Stop Store Locator & Maps Terms of Service

1. Agreement

These terms are an agreement between SalesSurge Labs ("we", "us") and the business that installs One Stop Store Locator & Maps (the "App") on a Shopify store ("you"). By installing or using the App you accept these terms and the privacy policy. If you install the App for a company, you confirm that you may bind it. Shopify's own terms also apply to your use of Shopify and the Shopify App Store.

2. What the App does

The App adds a store locator, a store locator page and location pages to your Shopify store, lets your customers search for your locations, and shows you where customers search, including areas where you have no location nearby. Features may change as we improve the App. We will not remove a core feature you rely on without notice.

3. Price

The App is free at the moment. If we introduce paid plans, we will tell you in advance, you will see the price before you agree to it, and charges will go through Shopify's billing. Nothing is charged without your approval in Shopify.

4. Your content and responsibilities

You own the content you add: locations, texts, images and settings. You give us the right to store, process and display it only to run the App for you. You are responsible for that content and confirm that:

  • your location details are accurate and you may publish them;
  • you have the rights to the logos and images you upload;
  • your use of the App, including lead capture, complies with the laws that apply to you, and your store's privacy policy tells your customers about it.

5. Acceptable use

You agree not to:

  • use the App for anything unlawful, misleading or harmful;
  • try to access other merchants' data, break the App's security, or overload it on purpose;
  • copy, resell or reverse engineer the App, except where the law allows it.

We may suspend access if you break these rules or put the App or other merchants at risk. Where possible we will tell you first.

6. Data and privacy

The privacy policy describes the data the App processes and how. For your customers' data you are the controller and we process it on your behalf, only to provide the App. When you uninstall the App, we delete your store's data as described in the privacy policy.

7. Third-party services

The App relies on services from others, including Shopify, Mapbox, OpenFreeMap and map data from OpenStreetMap contributors. Their availability and terms are outside our control, and attribution notices shown on the maps must stay visible. Area statistics in the App come from public US Census data and are shown for information only.

8. Our rights

The App, its code, design and documentation belong to SalesSurge Labs. These terms give you a non-exclusive, non-transferable right to use the App on your Shopify store while it is installed. If you send us feedback, we may use it without obligation to you.

9. Availability and support

We work to keep the App available and fast, but it may be interrupted for maintenance, updates or reasons outside our control. Support is by email at [email protected], and we aim to answer within two business days.

10. No warranty

To the extent the law allows, the App is provided "as is" and "as available". We do not promise that it will be error-free or uninterrupted, that search engines will index or rank your location pages, that map or distance data is exact, or that the App will produce any particular business result.

11. Limitation of liability

To the extent the law allows, we are not liable for indirect or consequential loss, lost profits, lost revenue or lost data. Our total liability for any claim connected with the App is limited to the amount you paid us for the App in the 12 months before the claim, or USD 100 if that amount is lower or nothing was paid. Nothing in these terms limits liability for intent or gross negligence, or any liability that cannot be limited by law.

12. Indemnity

You will cover our reasonable costs and losses from third-party claims caused by your content or by your use of the App in breach of these terms or the law.

13. Ending the agreement

You can stop at any time by uninstalling the App. We may end these terms with 30 days' notice, or immediately if you seriously breach them. Sections 4, 8, 10, 11 and 12 continue after the agreement ends.

14. Changes to these terms

We may update these terms. We will post the new version on this page with a new date and, for material changes, tell you before they take effect. If you keep using the App after that, the new terms apply.

15. Disputes

If you have a problem with the App or these terms, email us first at [email protected] and we will work with you to resolve it. Nothing in these terms takes away rights that the law where you are based gives you and that cannot be waived.
